Florida: anti-gay marriage amendment will be on the Nov. ballot

Sigh. We were on a roll there with positive news about civil equality...

First there was the ruling by New York's The Appellate Division of state Supreme Court that Canadian same-sex marriages must be recognized here. Kate and I married in Vancouver in 2004, so this was a big present.

Then, in Oregon, couples who wish to take advantage of the recently approved domestic partnership law may now do so as a federal judge tossed out a lawsuit attempting to prevent its implementation.

But it's time to roll up the sleeves for folks in the Sunshine State as the fundies have collected enough signatures to put a "marriage protection" measure on the ballot there. (Florida Sun-Sentinel):

"In less than 2 weeks we were able to collect 92,000 signatures, which we thought was remarkable," said John Stemberger, an Orlando lawyer and Florida4Marriage chairman.

Florida4Marriage's amendment would define marriage as "the legal union of only one man and one woman as husband and wife," and that "no other legal union that is treated as marriage or the substantial equivalent thereof shall be valid or recognized."

...Gov. Charlie Crist distanced himself from the issue when he took office, proclaiming himself a "live and let live" governor.

Now with voters being asked to decide on gay marriage when they head to the polls to pick the next president, the amendment could drive more voters on both sides of the issue to the polls.

Yes, this is going to be an election issue yet again, in a state that has been critical in deciding who ends up in the White House, placed in the center of the marriage equality storm. It cannot be avoided. It will force the intellectually dishonest leave-it-to-the states folks to answer for the ability of Florida to deny civil rights to a group of taxpaying residents.

Nadine Smith of Equality Florida and the Fairness for ALL Families Campaign urges people to reach out and educate voters on the issue; since the amendment would do away with existing domestic partnership protections. In a state like Florida, with many retirees, this can resonate with them as it did in Arizona, the only state that has turned away an amendment at the polls (in 2006).

I'm surprised the theocracy set would let it get on the ballots during the generals
These sorts of BS discriminatory laws usually do much better when it's only the bigots and those who are impacted by the bigots who turn out.  I think the next general will see a record-breaking turn-out that I hope will give this piece of crap insult a resounding defeat.

actually, that's not the case.
Bush/Rove have used similar proposals several times to entice repubs to the polls.  But I'm with ya - I hope this is defeated convincingly.  My hope is that repubs are so unenthusiastic and dems are so fired up this fall that the balance will tip in our favor.  But we are talking FL, so my hopes are frankly not too high.

Yeah, it is Flor-DUH
  The only state out of the fifty that doesn't allow Gays and Lesbians to adopt children.

 Yeah, it is a state that has been run by republicans for almost a decade.  At the same time peoples homeowner insurance has tripled, property taxes keep rising.  The realstate market is in the crapper.

 Yeppers, it is the state where the people did speak up and wanted the education system fixed by means of a constitutional amendment, only to have the powers at be (Jeb Bush was Gov. at that time) refuse to fund it while giving tax breaks to the wealthiest residents.  

 And what did the Flor-DUH voters do? Elect and re-elect more republicans!

 I believe this Amendment will pass do the the way most Floridians vote.  If the Voters there are finally fed up with the way things are going there and decide to toss the republicans out, than it will fail.

 Best of luck to you who still live there.

Difficult to call
Florida's electoral shenanigans are such that we can be sure("past behaviour is the best predictor of future behaviour"-William Rhenquist) that distrists that might support gay marriage will be undercounted. Then you have to deal with the electoral math of Florida.

This measure will certainly mobilize the conservative base in a state that has proven to be critical to electing republicans.

Inasmuch as marriage is the legal union of only one man and one woman as husband and wife, no other legal union that is treated as marriage or the substantial equivalent thereof shall be valid or recognized.

This amendment would seem to outlaw civil union and domestic partnership arrangements for opposite-sex couples while saying nothing about same-sex unions.  It defines marriage and then prohibits substantial equivalents.  Given the definition provided, wouldn't a partnership of two men or two women be substantially different?

Okay, so we're not likely to win any court cases in front of bigot judges with that argument.  But still, it's an illustration of the quality and clarity of laws written by superstitious assholes.

yes, it will outright ban civil unions. yes it is written differently that other states. yes, the people behind this are the same as every other state. And in every other state, they have come after domestic partnership protections. So, maybe this time will be different? yea, right. Go ahead and trust that dog. THAT DOG WILL BITE. They'll throw their grandmother under the bus, labor unions, heteros and anyone else to keep te gays from having equal rights and or protections under the law.

We have enough closeted conservative Republicans in D.C. already.  Enough! If McCain had to go there, doesn't Rick Perry have better hair?

Be glad
that to amend the FL constitution, 60% of voters have to approve it.  It will still be close.  I've said it a hundred times, if this passes, my partner and I will leave FL.  I guess the state could do without one more doctor (me) or divorce lawyer (my partner).  We don't have enough doctors here already and with FL's divorce rate near 60%, they can use all the divorce lawyers they can get to make sure marriage stays sacred.

My partner of 10 years Marty woke up this morning and went out to get our morning paper - St. Petersburg Times - normally a quiet person Marty went in to a fit of rage when she saw the Front Page headline - she responded by writing to the St. Pete Times - we'll let you know if she gets a response

"As a subscriber to your paper, I could not believe my eyes today when I saw your 1" (no less) headline,, "Gay marriage on ballot".  This headline, along with the sub-heading and first sentence of the article, ("The Gay marriage battle has arrived in Florida") were a dangerous and sad distortion of the truth.

Who would see this headline etc., and understand the issue?  How many busy people would feel they had to rush out and vote in Nov. to "save traditional marriage"?  How many busy people on Superbowl Sunday weekend would take the time to read the end of the article on page 15A?  How many would know that Florida ALREADY has a law banning gay marriage, and this amendment would NOT change it?  Finally, how many people would realize that because of the amendment's wording, the rights of many heterosexuals including those of our elderly population would be further compromised?

Did you really need to sell extra papers today at the expense of truth?"

Not only in FLORIDA, they are also trying this in CALIFORNIA
CALIFORNIA is also most likely to face an anti-gay ballot measure on the November2008 that would amend the state constitution to ban gay marriage, but probably not domestic partnerships.
